AND POTENTIAL POSSIBILITIES OF THE USE OF ELECTRONIC
EVIDENCE IN CIVIL PROCEDURE

The article examines electronic evidence through the implementation of the concept of
“electronic justice” (e-justice). It is argued that their use in the judicial process is a guarantee
of the availability of justice. The authors consider that e-justice does not exist today due
to an objective reason – the lack of sufficient information technology resources. However,
the courts can and should apply electronic forms and methods of administration of justice
in connection with global informatization in society. The use of electronic evidence should
be considered as one of the elements of e-justice. The authors examined the international
experience of legal regulation of electronic evidence, analyzed the Russian procedural
legislation and judicial practice. It is concluded that there is no need to consider electronic
evidence as independent means of proof only on the basis of their particular technical
component. On the other hand, it is necessary to establish rules for determining admissibility
and reliability, as well as to regulate the possible procedural actions of the court and the
litigants in the process scrutinizing the electronic evidence.
