The article deals with issues related to the use of new legal sources of evidence in the field of judicial
activities. The scientific work’s objective is research the problems related to necessity of civil
(arbitration) procedure’s adaptation to use of modern electronic technologies. We are talking
about such non-traditional means of proof as log files, information from various Internet services
(for example, the Internet archive Wayback Machine), electronic correspondence through mobile
applications (instant messengers), etc. By authors’ opinion “we are the witnesses” of changing the
paradigm of a judicial process. In such a situation, it becomes obvious that courts can and should
use all modern techniques and methods for researching and evaluating electronic (digital) evidence
for the correct resolutions of civil cases. Taking into account the Russian and international
legal experience, the thesis justifies that arguments regarding to the interpretation of legal norms
and policy of evidence law should be sought not only within the framework of the existing procedural
and substantive legislation. The idea of the interdisciplinary nature of the institute of judicial
evidence and modern legal doctrine fit in this scheme as well as possible.
