In this article experts from the field of medicine – psychiatry and forensic psychiatric
examination make a research on the current legislative requirements for the production of
forensic psychiatric examination in Russia. Forensic psychiatric examinations vary according
to the terms of the conduct, the legal status of the experts, the composition of the specialists
involved in the examination, etc. The article provides a detailed classification of forensic
psychiatric examinations; the procedure for their conduct, as well as the procedure for the
provision and attachment to the case of documents on the examination conducted. When
conducting a forensic psychiatric examination, the main importance for the conclusion about
the presence or absence of a legally significant mental state of the person being examined
has a diagnosis of the presence or absence of mental disorders and their qualifications for
a particular legal event. At the same time, an important role is played by the assessment
of the current and past mental state of the patient, the prediction of the course of mental
disorders, the elucidation of the influence of mental disorders on his behavior in the situation
under study. In this regard, the main thing in conducting a forensic psychiatric examination
is the diagnostic process. The authors state that the fulfillment of the requirements of the
current federal legislation in this area necessitates the development of a procedure for
organizing a forensic psychiatric examination.
