CURRENT TRENDS IN THE IMPACT OF THE ECHR
ON THE DEVELOPMENT OF CIVIL PROCEDURAL LAW
IN GERMANY

There are a number of opinions indicating the need to limit the impact of the ECHR on the
legal system of countries. However, it is impossible to deny the high importance of the European
Convention on Human Rights in the improvement of German law, including civil procedure.
The Convention retains outstanding value for the protection of human rights, and the system
of European international protection of rights created on its basis is called an example for the
whole world. In this article, the author attempts to summarize the system of all of changes in
civil procedure in Germany that have occurred since the beginning of the work of the ECHR
on an ongoing basis (1998) to the present, and examines recent trends in the European Court
of Human Rights to evaluate certain aspects of German civil procedure for their compliance
with the European Convention on Human Rights. The prevailing violation of para. 1 of Art. 6
of the ECHR identified by the European Court of Justice in cases against Germany was the
failure to comply with a reasonable duration of proceedings (at of the end of 2016). The author
conducted a comparative analysis of the regulation of liability for failure to comply with
reasonable terms of legal proceedings in Russia and Germany and also there is information
about three most important novelties of civil procedure in Germany, adopted since 1998.
