The article is devoted to clearly obsolete, and even partly anecdotal, from the point of view
of the author, the so-called unconditional grounds for the annulment of court decisions
in the appeal and cassation proceedings in civil and arbitration procedure. In connection
with changes in legislation on the judicial system and legal proceedings, only two of seven
unconditional grounds provided for by the Civil Procedure Code of the Russian Federation and
Arbitration Procedure Code of the Russian Federation, are currently of practical importance
for the annulment of judicial acts. The rest are used very rarely or not used at all, since they
were designed for collective consideration of civil and arbitration cases. The author believes
that in the procedural legislation as one of the fundamental principles of legal proceedings it
is necessary to fix the right of participants in the proceedings to be heard, which is known for
a long time and rather strictly observed by the judicial bodies of civilized states. As a universal
basis for the abolition of judicial acts in future procedural legislation it is proposed to establish
a gross violation of the fundamental principle or principles of civil procedure.
