The article analyzes an estoppel principle as a legal form of the denial of unfair conduct. The
author notes on understanding of the term “moral principles” and categories of fairness and
unfairness and influence of this factor on legal relations in different states. It is important to
know that in spite of various legal regulations of the same issues by states the basic principles
are regulated by same approaches as unfairness is usually manifested in misconduct. The
author makes classification of kinds of procedural estoppel, describes the types of estoppels
in the foreign doctrine. Attention is also paid to two areas of manifestation: “estoppel by
res judicata”, “estoppel by representation”. The author considers the situations related
to the enforcement of the estoppel principle and ensuring rules at patent law, succession
law, law of contracts and in sphere of children adoption for demonstration of universal
interdisciplinary role of the estoppel, exemplifies the Russian court practice on enforcement
of the procedural estoppels.
