Judicial defense of subjects of land relations rights in the system of land resources management

The interrelation of judicial defense of subjects of land relations’ rights and management
of land resources are searched in the article. The definitions of judicial defense, suggested
in the literature are examined, its place and role among the other forms of state defense
are described; the issue on the nature of this legal institute is still debatable. Formation of
judicial protection of rights of participants of land relations took place in several stages;
effective methods of such protection were formed. The structure of the right for judicial
defense, consisting of four opportunities, similar to the general structure of a subjective
right is explored. The specifics of judicial protection according to the subjects of land
relations’ rights is analyzed that is represented in obligatory presence of a public interest.
The limits of judicial protection of subjects of land relations’ rights are specified. The
traditional (according to the type of land relations) and original (according to their nature)
classifications of the land justiciable rights are given. On the basis of performed analysis
the authorial definition of judicial protection of subjects of land relations’ rights is done,
its place in the mechanism of management of land resources is defined.
