Categories of the Whole and Part in Civil and Arbitration Procedural Law

In the article, relying on “the whole” and “part” categories, the author came to the
conclusion that not only the whole can be not only the system of civil procedural law, but
summative (non-systemic) legal entities, part of which are the rules and institutions of civil
procedural law, and the rules and institutions of other branches of law and legal entities.
Summative legal entities are also integrity, parts of which are heterogeneous and united
not by the subject of legal regulation, i.e. not on objective (system), but by other subjective
characteristics (goals, the existence of general principles, stages of development of activities,
similar in content institutions, etc.). There are identified and addressed integral summative
(not system) entities, including: 1) norms and institutions of civil procedural law and
enforcement proceedings; 2) norms and institutions of civil procedural law and norms
and institutions of arbitration procedural law, norms regulating notarial proceedings, as
well as regulating the activities of arbitration courts and commissions on labor disputes;
3) branches of civil procedural, criminal procedural and judicial law (judicial law);
4) legal institutions of different branches of law. Summative (non-system) entities are
making a worthy contribution to the improvement of civil procedural law and other
branches of law. The author considers highly relevant research summative (non-system)
entities for both the theory of civil procedure law and practice.
