Commentary to the Civil Procedure Code of the Russian Federation (continuation)

This commentary provides an analysis of the Chapter 47.1 «Proceedings in the Cases Connected with Functions of Assistance Concerning Arbitration Tribunals» of the Section VI «The Proceedings Related to the Functions of Assistance and Control in Respect of Arbitration Tribunals» of the Civil Procedure Code of the Russian Federation. From 1 September 2016, the norms of the former Federal law of 24 July 2002 No. 102-FZ «On Arbitration Tribunals in the Russian Federation» were not applied in connection with the adoption and entry into force of the new Federal law of 29 December 2015 No. 382-FZ «On Arbitration (Arbitration Proceedings) in the Russian Federation». This act significantly reformed the system of courts of arbitration, procedure of arbitration, the regulation on the arbitration agreement and so on. This in turn led to significant changes in the Civil Procedure Code and Arbitration Procedure Code and certain other provisions of the legislation of the Russian Federation. So, now in the Russian Federation permanent arbitration institutions are established as non-profit organizations. At the same time, previously Civil Procedure Code did not contain the Chapter 47.1 «Proceedings in the Cases Connected with Functions of Assistance Concerning Arbitration Tribunals», and this institution was not familiar to the Russian legal system. This Chapter regulates the procedure of resolving issues related to the challenge of the arbitrator, appointment of the arbitrator, termination of the powers of the arbitrator. It should be noted that state court also assists the arbitral tribunal in the collection of evidence in accordance with Article 63.1 of the Civil Procedure Code «Requests from the Arbitral Tribunal for Assistance in Obtaining Evidence».
