E-Justice: Reality or a New-Fashioned Term?

A.T. BONNER,
Doctor of Legal Sciences, Professor of the Department of Civil and
Administrative Procedure of the Kutafin Moscow State Law University (MSAL)

The author of the article considers various understanding of the term «e-justice» in the doctrine of Russian civil procedure. Information technologies significantly facilitate judicial activity in areas of finding the necessary documents, establishing procedural contacts with participants in the procedure and technical registration of acts of justice. However, according to the author, it is hardly possible to entrust even to the most sophisticated computer evaluation of evidence, establishing the circumstances of the case, interpreting the law and adopting an act of justice on behalf of the state. «E-justice» is more a newfashioned term, widely used in literature and practical judicial activity, but it does not mean «justice» in the proper sense of the word, but the broadest application of modern information technologies in the judicial system. The author is quite pragmatic about the statements that the technical revolution will become an absolute «chance of transparency of justice». The author also says about peculiar way of the development of the Russian judicial system and the ongoing judicial reform. The real judicial reform should consist of legislative, organizational, professional and some other aspects; as for the optimization of legal proceedings, there are many opportunities to improve it still.

Keywords: e-justice; information technologies; court; civil procedure; court reform.
