On Supreme Court Models and Revocation of Precedents

The article is devoted to descriptive-objective research of two models of Supreme Court which realize administration of justice in countries of civil law and common law. The author reviews classical and contemporary functions of supreme courts; gives classification of models of supreme courts: there are reactive and proactive models. As a result of this kind of identification the article reflects research of different forms of executive actions in each of these models and also considers the method of making precedents. The purpose of the research is to take a look on functions and forms of activity of courts of cassation instance through perspective of the theory of legal execution. This essay develops the main ideas through a comparative and historical method. Therefore, we aim to individualize and set some differences between the French cour de cassation (1790) and the contemporary civil law supreme courts. This will show two models of supreme courts: a reactive one and a proactive one. The article examines the implementation of the proactive role of the Supreme Court and the practice of overruling or rejecting precedents. In conclusion, the author proposes several changes and drafts some critics upon a recent Peruvian constitutional precedent created during the year 2014.
