Review of General Provisions of the New Civil Procedure Code of the Republic of Kazakhstan

Civil procedural legislation was updated in the Republic of Kazakhstan. The new Civil Procedure Code of the Republic of Kazakhstan has become in force since 1 January 2016. The reform of the legislation on civil legal proceedings in the Republic of Kazakhstan may attract interest not only of representatives of procedural science in this state, but also in Russia. The article gives overview of the general provisions of the new Civil Procedure Code of the Republic of Kazakhstan, covering institutions of sources, principles of civil procedure, parties involved in the case, representation in courts, evidences, legal expenses, liability measures, notices and others. Comparison is made between certain norms of civil procedural legislation of the Republic of Kazakhstan and the Russian Federation. Some of normative solutions of existing problems of judicial activity proposed by colleagues from Kazakhstan are very interesting and can be fully explored and correlated with existing solutions and approaches in Russia with aim of their possible subsequent perception by Russian legislators.
