В практике нередко приходится сталкиваться с тем, что сторона открыто
врет либо явно скрывает доказательства, которые у нее есть. Есть только
общая норма о том, что нужно добросовестно пользоваться своими процессу-
альными обязанностями. Немецкие процессуалисты обосновывали право на ложь
в процессе: «никто не обязан вооружать противника против себя». Тем не менее
в итоге категорический императив Канта получил отражение в Гражданском
процессуальном уложении Германии. Не существовало обязанности быть прав-
дивой для стороны в отечественном процессе. В обществе разрушается доверие
к суду, который принимает ложь. Как следствие, суды утрачивают легитим-
ность. Вступление в силу решения, основанного на лжи, рождает новый спор. На
практике же сегодня является даже нормой, когда одна из сторон прямо во время
судебного заседания «достает из кармана» новые доказательства для эффекта
неожиданности другой стороны – сокрытие доказательств является нормальной
практикой. И если решение основано на ложных доказательствах, а ранее сокры-
тые суд не принимает как новые, получается, что пересмотр дела не будет воз-
можен. Поэтому пока в судах можно будет лгать, суды будут завалены.
