Дискуссия о возможности и необходимости трансграничного действия судебных решении

В статье автор рассматривает существующие подходы к статусу зарубежных судебных актов в национальном правопорядке и необходимости их признания. Отмечается, что отсутствует единство во мнениях относительно существо- вания обязанности государства признавать решения зарубежных государственных судов, что во многом обусловлено доминирующей в науке и практике концепцией государственного суверенитета. В то же время в новых социальных, экономических и политических условиях происходит пересмотр данной позиции, и в настоящее время процесс признания расширяется, охватывая новые категории актов, и подвергается либерализации, предусматривая более простые механизмы переноса зарубежных решений в национальный правопорядок. Вместе с тем природа этого процесса, равно как и его направление и внутренняя логика, остаются недостаточно исследованными. Кроме того, неясным остается главный вопрос о том, какую позицию должно занимать государство по отношению к зарубежным актам и каким статусом их наделять. В рамках данной статьи предпринята попытка осветить основные проблемы и предложить возможные способы их решения.
