ОПТИМИЗАЦИИ СУДЕБНОЙ НАГРУЗКИ

Цель оптимизации судебной нагрузки не может быть достигнута за счет дальней-
шего упрощения правил гражданского судопроизводства. Способы решения пробле-
мы высокой нагрузки на судей необходимо искать в изменениях организационной
стороны судебной деятельности. Автор предлагает существенно повысить право-
вой статус помощника судьи. Максимальное упрощение процедуры выдачи судебно-
го приказа и бесспорный характер требований по делам приказного производства,
особенности рассмотрения дел в упрощенном порядке, относительная несложность
таких дел, но в то же время их массовость являются предпосылками для наделе-
ния помощника судьи компетенцией по осуществлению приказного производства
и рассмотрению гражданских дел в порядке упрощенного производства. Правовое
регулирование указанных институтов не соответствует ряду принципов цивили-
стического процесса. Такая судебная деятельность по существу не является право-
судием, учитывая существенные изъятия из гражданской процессуальной формы
при выдаче судебных приказов и рассмотрении дел в порядке упрощенного произ-
водства. В связи с этим предлагаемые изменения законодательства не противоре-
чат конституционному принципу осуществления правосудия только судом. Такой
способ оптимизации судебной нагрузки не приведет к снижению качества и эффек-
тивности защиты прав и законных интересов лиц, участвующих в деле.
