THE GUIDELINES FOR EFFECTIVE INTERPRETATION OF THE ARBITRATION AGREEMENT

The article examines the alterations recently made to an arbitration agreement, and utilizes a new
approach which enables the agreement to be interpreted in the most effective way. The article
concludes that the validity and diligence of the arbitration agreements positively depend on the
formation of new arbitration institutions. It is necessary to observe the private law principles of
the procedure for protecting the rights and legitimate interests of citizens and organizations. The
main guarantee for this is the use of an effective interpretation of the arbitration agreement as
a principle and as a special method. The authors refer to the preconditions for a pro-arbitration
approach to the interpretation of the arbitration agreement, which appeared in the judicial
practice. This approach is conditioned by the need for a broad understanding of the scope of the
arbitration agreement, the forms and methods of its conclusion, in maintaining its strength when
changing parties in the obligation, when the transaction is declared invalid, if it has a reference to
the settlement of the dispute between the parties in the arbitration court, and to expand the list
of arbitration disputes. However, the boundaries for observing an effective interpretation of the
arbitration agreement should be outlined by the requirements for the procedure of the formulation
and conclusion of the arbitration agreement, to the signs of its validity and enforceability, and,
in general, to correspond to the protection of a bona fide party.
