This commentary provides an analysis of Chapter 46 «Proceedings on Cases on Disputing Decisions of Arbitration Tribunals» and Chapter 47 «Proceedings on the Issue of Writs for Enforcement of Arbitral Decisions» of Section VI «Proceedings Related to the Functions of Assistance and Control in Respect of Arbitration Tribunals» of the Civil Procedure Code of the Russian Federation. From 1 September 2016, the norms of the former Federal law of 24 July 2002 No. 102-FZ «On Arbitration Tribunals in the Russian Federation» were not applied in connection with the adoption and entry into force of the new Federal law of 29 December 2015 No. 382-FZ «On Arbitration (Arbitration Proceedings) in the Russian Federation ». This act significantly reformed the system of courts of arbitration, procedure of arbitration, the regulation on the arbitration agreement and so on. This in turn led to significant changes in the Civil Procedure Code and Arbitration Procedure Code and some other provisions of the legislation of the Russian Federation. So, now in the Russian Federation permanent arbitration institutions are established as non-profit organizations. Of the most notable changes to Chapter 46 of the Civil Procedure Code the appearance of new Article 422.1 «Consideration of the Application for Reversal of the Arbitration Decision of the Preliminary Nature of Its Jurisdiction» can be noted, which determines the order of consideration of the statement. You can also note the replacement of the category of «violation of the fundamental principles of law» to a broader category of «contradiction to the public policy of the Russian Federation» as a basis of cancellation of the arbitral decision or refusal to issue a writ of execution, which jurisprudence defines as fundamental legal principles which possess the highest imperative, universal, of special social and public significance, and that form the basis of building economic, political and legal system of the state. Such basis, in particular, includes the prohibition of commission of acts expressly prohibited by super-mandatory norms of Russian legislation (Article 1192 of the Civil Code of the Russian Federation), if these actions damage the sovereignty or security of the state, affect the interests of large social groups, violated the constitutional rights and freedoms of individuals.
