On Norms of Procedural Law, Their Structure and Content

The author takes a view for different classifications of legal norms, their characteristics and inside organization, structure elements of norms and forming by them constructions (formulas) of future legal relations. The article substantiates the necessity of singling out two types of norms of civil procedural law, which have common system-forming characteristics, but are distinguished on the functional orientation, – regulative and protective ones. It is substantiated that the differences in the functional orientation of the norms of law have influenced their logical and legal construction. The author proves that the regulatory norms, forming the model of the participants in the legal relationship, contain only two elements – hypothesis and twopart disposition, which fixes the model of the proper legal relationship. And the protective norms of civil procedural law, which fix the connection between the unlawful conduct of the participant in the proceedings and the subsequent coercive measures, contain three elements – disposition, hypothesis and sanction. Analysis of the author shows structure and content of legal norms, and also allows to see correlation of norms and legal prescriptions.
