Language and Civil Procedural Law

The article investigates the interaction and the relationship of language and civil procedural law. Linguistic approach concerning to the system of modernization of justice system is meaningful and it becomes more and more widespread: failure to comply with basic linguistic rules at procedural laws or judgments prevents the realization of citizens’ rights. Carefulness, thoroughness, and even pickiness to legal language are necessary and respect for linguistic norms is positive moment always. It is interesting to note that some scholars suggested learning linguistic aspects of legal proceedings as an independent field as linguistics has specific and relatively defined boundaries. The author expresses an opinion that text of procedural laws must be accessible to understanding not only by legal community. There is necessity of improving terms in both sphere of legislation and law enforcement activity; legal language should serve the purposes and tasks of the administration of justice in civil cases. The author suggests group types of language contacts and civil procedure law; the article deals with certain aspects of application of civil procedural metaphors.
