System of Civil Jurisdiction of the Republic of Belarus: Current State and Development Prospects

The article explores the state of civil jurisdiction in the Republic of Belarus and prospects of its development. Primarily civil jurisdiction includes activities to protect rights and interests in the sphere of civil turnover, i.e. the activity that takes place in case of violation or contestation of the said rights and interests. Courts of general jurisdiction of the Republic of Belarus are integrated into the system of civil jurisdiction only in part of its competence, the rest of their powers they implement in the field of criminal and administrativetort jurisdiction. If we turn to the Belarusian notariat, we will see that officials of the civil jurisdiction in «pure» here can only be considered notaries, because the rest of the subjects included in the notarial system, implement the notarial functions only a subsidiary, their main competence relates to the field of public administration. It is difficult to determine in certain types of civil jurisdiction, due to the nature of their regulation, are they a form of conflict resolution or settlement of conflict in its purest form, because they combine both features. For example, according to the legislation of the Republic of Belarus collective labour disputes are considered by the conciliation commission, mediation and labor arbitration. The conciliation commission considers the dispute through negotiations with representative bodies of workers, the employer, owner or authorized body and makes a decision only on the agreement of the parties, collective labor dispute is terminated only with the agreement with the decision of the conciliation commission.
