Institute of Organizational (Representative) Class Action Abroad

The article is devoted to application of the institute of organizational class actions in countries with various systems of law. Class action is an important safeguard to protect rights and legitimate interests of large groups of people and it’s already proven in advanced foreign legal systems. One of the most popular forms of class action in countries with a continental legal system (France, Sweden, Argentina) is an public class action, which is initiated by nongovernmental associations, the so-called «ideological claimants» (associations, foundations, non-governmental organizations) in defense of violated collective rights of a large group of people or unspecified persons in the most vulnerable areas of economic life. The institution of collective protection of rights in countries with a common legal system received smaller expansion (USA, Australia, Canada), which are traditionally used representative class actions. Nevertheless, countries with a common legal system, as the United Kingdom (England and Wales) actively use the tools of social protection of violated rights and interests of citizens. At the same time, the scope of these claims and the mechanism (from suiting a case before adjudication) of judicial protection of collective rights and public interest by non-governmental associations have its own characteristics, which can be used by Russian legislators to effectively protect the population.
