Rejection of a Claim in the Mechanism of Judicial Protection of Civil Rights

The article analyzes the rejection of a claim in the mechanism of judicial protection. In the procedural literature of recent years we are increasingly finding an opinion on the limitation of the right to judicial protection, legally veiled in paragraph 1 of Part 1 of Article 134 and paragraph 2 of Article 220 of the Civil Procedure Code of the Russian Federation, as well as to the conclusion of a settlement agreement, which prevents to reception of the judicial protection of violated rights and interests protected by law. The need to resolve conflicts of jurisdiction, ensuring the unity of law enforcement – main arguments in favor of a unified procedure code, requested by time. In many cases, it is theoretically impossible to establish the presence or absence of a base for refusing to accept the statement of a claim (application). For example, to establish the existence of an enforceable court decision on the identity claim is hardly possible in the stage of commencement of civil case on the basis of submitted documents by the interested party (the statement of claim and documents attached thereto). The author describes theoretical and practical problems of realization of the basis for refusal in acceptance of the statement of claim on the basis of historical analysis of procedural rules governing the institute and the Concept of the Unified Civil Procedure Code of the Russian Federation.
