Judgments of Supreme Judicial Authorities in the Concept of the Unified Civil Procedure Code of the Russian Federation

The article is devoted to consideration of the value of judgments of the Supreme Court of the Russian Federation, the Constitutional Court of the Russian Federation, the European Court of Human Rights in the concept of unified civil procedural legislation. The value and character of decisions of supreme judicial authorities can be determined by analyzing the competence of these authorities. We note that the Supreme Court of the Russian Federation as the authority supervising the activity of courts, stabilizes the enforcement process to further ensure the full protection of rights and interests of stakeholders. In addition to the supervisory authority, the Supreme Court of the Russian Federation is entitled to interpret regulations of the legislation. In his turn the Constitutional Court of the Russian Federation in the field of civil procedure provides: interpretation of the Constitution of the Russian Federation; settlement of questions on the constitutionality of legal rules applying in civil proceedings, at the request of courts; administration of complaints about violation of constitutional rights and freedoms by applied in a particular case law. The author makes a conclusion about the need to fix mandatory values, as well as ways to overcome the binding force of these acts for courts.
