Objectives of the Legal Profession and Principles of Lawyer Ethics

The article is devoted to objectives and the purpose of the legal profession in civil and criminal procedure. The author notes that society is doubly interested in the procedural competition: on the one hand, it is deeply sympathizes with the activities of the government, which is armed to its security and peace, on the other hand, it may not be indifferent to the fate of the accused. Just as the prosecutor represents interests of the state, so the lawyer must be the representative of society. But unlike the prosecutor, who gets a formal mandate from the public authorities, the lawyer should act as the representative without the authorization of society. In Poland and most other countries, lawyers in civil cases perform one more function in addition to the legal protection: they work instead of participants in the process as their representatives. Lawyers are forced to act in two roles: as representatives of interests of society and as representatives of interests of individual members of society. But interests of a private person do not always satisfy interests of society.
