Critical Reflections about the New Brazilian Civil Procedure Code

The article criticize the main provisions of the new Brazilian Code of Civil Procedure, such as change of the system of procedural principles, increase of the judge’s power, resolution of repetitive demands. Тhe main goal of the new civil procedure code would be to obtain, in one shot, to attend the so wanted speed of the procedure without losing the constitutional guarantees of it. The new Civil Procedure Code has still been debated. The parts, the members of the Public Prosecution, and the lawyers are responsible, too, for the required jurisdictional provision. The participation in symmetrical parity, guaranteeing the contradictory, the full defense and the isonomy is what assure the parts, the Public Prosecution, the lawyers and the judge the effective jurisdictional provision. The judge is just another component needed to the effective jurisdictional activities, but not the only one and not the main one. New Brazilian Civil Procedure Code doesn’t say, textually, how to understand if a proceeding is violating its reasonable length or not. This means that the new Brazilian Code of Civil Procedure doesn’t offer objective standards to identify when a procedure violated or not the fundamental right of a process without improper delays. So, it is a standard procedure with open concept, undetermined, which as a general rule, ends also becoming its more complex application.
