Book Review «Andrews on Civil Processes»

The article gives a brief overview of the monograph «Andrews on Civil Processes», one of the leading experts in the field of civil justice, the English Professor Neil Andrews. The author notes that English law is very common in business: it is highly stable and predictable. The main factor of stability and predictability in English law and the English courts are English civil litigation. Unlike courts of the continental legal tradition, the role of the Court in England has historically been extremely passive, the Court only has the evidence presented by the parties, and has made its decision, and rarely interfering in the management of business. The parties themselves determine what evidence to present, whom to call as witnesses and experts. Provide reasoning for full reimbursement of court costs, including system of conditional remuneration of lawyers (contingency fee), insurance against adverse outcome, on the amount of damages, etc.
