The Reform and Development of the Institutions of Evidence in Russia: Results of the Decade

The article is devoted to the development of the institution of proof in civil proceedings since the adoption of the current Code of Civil Procedure of the Russian Federation. The overall objective of proof in civil cases is correct and timely determination of the circumstances of the case. In modern law, the term «right» ceases to be evaluative, subjective. The concept of proper consideration and resolution of the civil case from the point of view of the mechanism of judicial protection of rights reflects the result of the operation as a whole mechanism, and all its constituent elements. As part of the overall goal of proving – correct and timely establishing the facts of the case – should be distinguished between intermediate targets, i.e. targets that are facing the subjects of the evidentiary activity in the individual stages of the process. The author critically approaches the lawful opportunity of not to make the reasoning of the judgment, as seriously prejudiced of judicial acts. As an output, the author notes that the need should be improved regulatory in the institutions of the «electronic evidence», real evidence, procedural forms of the part’s recognition, the legal status of the specialist, and many others. These issues can only be a result of the reform of the system of institutions that make up the law of evidence, and their application in civil proceedings.
