The article is devoted to the identification and study of contractual elements in civil and
arbitration procedure. This issue is considered in the context of the ratio of dispositive
and imperative principles in the method of regulation of civil procedural and arbitration
procedural law. Attention is drawn to the fact that the parties in the framework of legal
proceedings cannot be as free as in the field of material legal relations. The contradiction
that has arisen between freedom in the sphere of material relations and certain restrictions
in the procedural sphere can be removed using a number of procedural means, which
include procedural agreements. Their purpose is to ensure coordination of the interests of
the disputing parties in the choice of methods and forms of protection, the rights belonging to
them, in the conditions of a dispositive and adversarial proceedings. Procedural agreements
are considered in the system of interactions between parties and other persons involved
in the case. The author believes that procedural cooperation in modern legal proceedings
cannot be limited only to the interaction between the court and the persons participating
in the case. Modern court proceedings, based on the principle of dispositivity, allow in some
cases procedural interactions between persons involved in a case. The central place in the
work is the issue of the impact of procedural agreements on the system of civil procedural
and arbitration procedural relations. According to the author, the object of administrative
activity of the court has a more complex structure than the structure mediated exclusively
by vertical legal relations.
