AND THE PRESUMPTION OF INNOCENCE
IN CIVIL MATTERS

The article provides a detailed, historical and theoretical analysis of the formation and
development of such general legal principles as the principles of good faith and the
presumption of innocence, which have become classical and fundamental, for modern
civil law. The meaning and content of such a great in its axiological meaning of the source
of law as the Law of the Twelve Tables containing the first prerequisites of the principles
of the presumption of innocence and good faith are separately revealed. In particular,
separately described the role of decemvirs when creating the Law of the Twelve Tables, the
most ancient of which was the commission for judicial proceedings in civil cases addressing
civil disputes according to the formulas and principles of law (decemviri litibus judicandis),
and at the beginning of the IV century BC: decemvirs with consular authority (decemviri
consulari imperio legibus scribundis), through which the light appeared first ten tables,
making centuriate assemblies. The article draws attention to the distinctive and similar
features of the principles of “good conscience” and “good faith”, both in terms of subjective
and objective approaches.
