The article discusses the concept of interest as a subject of judicial protection, its relationship
with subjective law. The author analyzes the normative regulation of the category of
“interest” in the current civil and civil procedural legislation. The necessity of judicial
protection of interests not reflected in the law is substantiated, the conditions for the
provision of such protection are proposed. The conditions for protecting interest include:
the presence of interest and its belonging to a specific person or group of persons; lack
of contradiction of interest to the rule of law and morality; setting the goal of protecting
interest; establishing the consequences of failure to protect interest; a statement of the
absence of potentially conflicting interests or an assessment of the priority of opposing
interests. Unlike personal and public interests, the interests of the state can be protected
only if such an interest is directly fixed in a legal act.
