ON JUDICIAL EXAMINATION
AS A TOOL OF A FAIR PROCEDURE

Traditionally, the problems of judicial examination were investigated in the context of
judicial evidence, however, in modern conditions of the materialization of civil procedure,
judicial examination and its legislative concept can be understood within a fair trial
term. The author of the article considers the doctrine in the field of this issue, the judicial
examination is analyzed as a phenomenon from various sides. The author highlights its
procedural concept, – as a tool for the implementation of a fair procedure, it also dwells
more on psychological expertise and its features. “Fair expertise as a way to implement
a fair proceedings” comes up against a number of traditional, but still unsolved problems,
including discrepancies in the categories of psychology in jurisprudence, filling them with
a different meaning. The article raises the question of the wording of the norms contained in
the codes of the Russian Federation, which form the general legal prerequisite for the use of
forensic examination. With the external similarity of formulations, the concept is different
in the codes, which gives rise to various practical difficulties. The author identifies areas that
need to be improved in domestic jurisprudence, and expresses her opinion on the concept of
conducting a judicial examination, which would respond to the idea of a fair procedure.
