FEATURES OF PROOF IN CASES OF COMPLIANCE ASSESSMENT

Judicial challenge of normative legal acts is a significant and the most complex category of
cases related to administrative proceedings. Proof is the basis of any process, in addition, the
Constitution of the Russian Federation establishes a ban on the use of evidence that is not
provided by Federal law, besides, a more thorough approach is needed to determine the means
that can be used in proving. The existing differences in the definition of the list of evidence in
the procedural codes are not due to the specifics of the procedural activities. It is necessary to
transfer the rule of the Arbitration Procedure Code on the use of expert advice as evidence
to the Code of Administrative Proceedings of the Russian Federation. It is necessary to clarify
the status of the specialist himself as a source of evidence and as a person that assisting
in the collection and investigation of evidence. It is also important to legalize the issue of the
possibility of expertise on legal issues. At the same time, recommendations on the appointment
and conduct of such expertise are needed. Questions on the subject of proof should be
specified in relation to types of the disputed regulatory legal acts. The term “subject of proof”
does not need to be transferred to the rule of law. The introduction of legal expertise should
affect training in the specialty. The introduction of legal expertise should affect training in the
specialty of “Forensic examination”. We need an organizational restructuring of the judicial
boards, so that cases under the rules of the Code of Administrative Proceedings of the Russian
Federation were considered by a specialized board.
