AND THE ACTUAL SITUATION IN PROVING IN PROCEEDINGS

OF CIVIL CASES

The idea of moving of the burden of proof is quite common in modern legal systems, and it

is usual in the practice of international arbitration, the European Court of Human Rights.

The concept of a dynamic burden of proof is traditional for the Russian legal system. Some

Russian scholars support the idea of shifting the burden of proof, but in general, the science

of Russian procedural law has a rather negative attitude towards it. There are all the

necessary prerequisites for a preliminary primary distribution of the burden of proof in the

form of general and special rules in the Russian procedure. Otherwise, the institute will not

be able to perform the function of eliminating uncertainty in the event that it will not be

possible to establish the required facts reliably with the help of evidence. Subsequent clarification

of the burden of proof is possible only in the case of a supplement due to various

reasons for the subject and the limits of proof by new circumstances not previously discussed.

The denial by the Russian procedural science of the position of the admissibility of

shifting the burden of proof is determined by two groups of circumstances, the predetermination

of the burden of proof by material law and proper procedural reasons. The article

is devoted to the distribution of the burden of proof in domestic civil proceedings and the

possibility of shifting the burden of proof depending on the presented evidence.
