OF ITS TRANSFERS IN CIVIL PROCEDURE

The article considers the issue of the implementation of linguistic guarantees in civil
procedural relations in the context of the results of the translator’s activities and their special
evidentiary value. Based on the conducted research, all procedural sources established
the main criterion that characterizes a translator is fluency in the language in which the
legal proceedings are conducted and in the language whose knowledge is necessary for
translation. However, it is important to note that the legislation does not provide for the
determination of the level of fluency in a language by setting minimum requirements for
an interpreter. Analysis of the legal provisions formulated in the Civil Procedure Code of
the Russian Federation, and in case of their absence, borrowed by analogy of the law in
related procedural sources, allows us to identify two criteria that a person acting in civil
procedure as a translator must meet. As a first criterion, one can distinguish the fluency of
the language in which the proceedings are conducted and the language, the knowledge of
which is necessary for translation and the obligatory procedural legitimation of the person
who is fluent in the languages necessary for the administration of justice.
