This commentary is an updated part of the article-by-article commentary to the Arbitration

Procedure Code of the Russian Federation, published in 2013 under the editorship of

P.V. Krasheninnikov. This commentary presents an updated analysis of Chapter 2

“Composition of the Court” of the Arbitration Procedure Code of the Russian Federation. In

particular, it reflects the following most significant changes. The Supreme Arbitration Court

of the Russian Federation has been liquidated and its competence to resolve disputes in the

field of business and other economic activities has now been assigned to the competence of

the Supreme Court of the Russian Federation. A number of clarifications of the Supreme

Arbitration Court of the Russian Federation have become invalid. A number of changes

to the Federal law of 30 May 2001 No. 70-FZ “On Arbitration Assessors of Arbitration

Courts of Entity of the Russian Federation”. There are new types/features of arbitration

procedure: writ proceedings, consideration of cases on corporate disputes. Changes of the

order of formation of structure of arbitration court under the Federal law of 29 July 2018

No. 265-FZ “On Amendments to Some Legal Acts of the Russian Federation” which have

not yet come into force are considered.
