OF ADMINISTRATIVE PROCEEDINGS OF THE RUSSIAN FEDERATION

AS A MIRROR OF PROCEDURAL EVOLUTION

The Code of Administrative Proceedings of the Russian Federation, which came into force in

2015, has already got numerous novations. In the author’s opinion, such an active reform,

however, is not a private task of improvement, but more global process of processualization

and the incorporation of the Code into a developing and unified civil procedural form,

“a chance to become an acceptable member of the ‘procedural family’”. It will be possible when

the judicial procedures for dealing with cases will be correlated with the general principles

and rules of the civil procedural form. The Code of Administrative Proceedings of the Russian

Federation is a procedural copy of the Civil Procedure Code of the Russian Federation not

only in form but also in the content of judicial procedures for the consideration of cases. On

the one hand, this is evidence of the universality of the procedural form, embodied in the Civil

Procedure Code. On the other hand, some literal borrowings of the elements of the general

concept of procedural form outside their own legislative concept give rise to a “rupture of

meanings”. The author examines the development of the Code of Administrative Proceedings

and the conceptual challenges that need to be addressed to determine the legislative vector

of the future civil procedure. The article presents a number of existing problems, as well as

methods for their solution, which are necessary for the development of future legislation in

the sphere of civil procedure.
