IMPLEMENTING COMPLIANCE ASSESSMENT

AS INSTITUTION OF ADMINISTRATIVE PROCEEDINGS

IN THE LATIN AMERICA COUNTRIES

The article goes on to study different models of court compliance assessment (procedure of

the court review of compliance of a regulatory act to the regulatory acts having superior legal

force) as one of the institutions of administrative proceedings. The article contemplates topical

issues of its organization in a number of Latin American countries, i.e. Argentine Republic,

Oriental Republic of Uruguay, Republic of Colombia and Republic of Nicaragua. The author

studies statutory provisions pertinent to the said topics, as well as the procedure of review

by different courts of the validity (legitimacy) of normative legal acts adopted at different

levels. Special focus is put on administrative acts of normative (general) nature, principles of

exercising compliance assessment, its subject, consequences, relevant authorities exercising

such assessment, as well as legal status of persons participating in its implementation. Finally

the author arrives at the conclusion that despite considerable similarity of economic and

legal systems of the reviewed Latin American countries, the systems of court compliance

assessment so far established in those countries have their specific features.
