Abuse of Procedural Rights: Diagnosis and Treatment (Commentary of the Decree of the Supreme Court of the Russian Federation of 17 January 2017 No. 36-KG16-26)

The article provides a commentary on the Decree of the Supreme Court of the Russian Federation of 17 January 2017 No. 36-KG16-26 (hereinafter – Decree of 17 January 2017), in which the Supreme Court of the Russian Federation carefully analyzed the actual procedural behavior of the participants in the case, pointed out that significant violations of the procedural rights influence the outcome of the case, and may lead to violation of the rights, freedoms and legitimate interests of the participants in the process. The Decree of 17 January 2017 resolved a number of complex issues of qualifying abuse of procedural law. The Supreme Court of the Russian Federation drew attention to the fact that, even in a competitive process, the court must exercise the powers conferred on it by the procedural law, arising from the principle of the judiciary; there is also accent made on the fundamental importance of strict compliance with the rules of mutual binding judicial acts of arbitration courts and courts of general jurisdiction, the inadmissibility of ignoring the rules of prejudice. It is necessary to stop the abuse of procedural rights. The author examines the materials of judicial practice and analyzes significant violations of rights in specific cases considered by the court. The article substantiates the need to improve the procedural legislation, suggests ways of such improvement.
